From risk to reputational strength: This is how to ensure social safety in governance

12 March 2026

Strong governance starts not only with rules and structures, but especially with whether directors and supervisors feel free to speak out. That is precisely where social safety touches on good corporate governance. For companies, this is relevant because the quality of decision-making is directly linked to the room for critical questions, dissenting opinions and timely signals. But how do you ensure that social safety?

Social safety goes beyond preventing undesirable behaviour. It is about an environment in which people can speak up and develop without fear of negative consequences. Tension, reticence and implicit assumptions can drive dialogue in the boardroom and thus negatively affect the quality of decision-making.

The role of the board is essential here. When conversations are perceived as unsafe, painful or damaging, directors are more likely to withdraw, withhold information or join the group. This damages the quality of decision-making. The board must therefore actively contribute to a context in which questions can be asked, dissenting views can be discussed and inappropriate behaviour is immediately corrected.

For companies and institutions, a practical approach starts with an honest diagnosis of board or supervisory dynamics. Is there really room for dissent? Who speaks up and who remains silent? On this basis, concrete governance agreements can be made on behaviour, participation and reflection.

TK can support with a combination of governance advice and employment law expertise. We help with:

  • assessing existing governance arrangements,
  • tightening up codes of conduct and regulations,
  • designing interventions in the event of signals of insecurity; and
  • guiding sensitive processes where governance, supervision and industrial relations come together.

In doing so, we look not only at risks, but also at how your organisation can deploy social safety as part of strong and future-proof governance.
